Glossary of Terms

Charterer/Student/Client:

Refers to the individual or group booking with Miami Sailing School, LLC. This includes anyone booking on behalf of others, representing the entire group.

The Company/Us:

Denotes Miami Sailing School, LLC, its owner, and operator.

Charters/Lessons:

Refers to the sailing events and associated services being booked under these terms and conditions.

Party/Parties:

Refers to both the Client and the Company, or either one of them.

Services:

Refers to the services offered by Miami Sailing School, LLC.

Add-on Services:

Additional services provided beyond the base package as detailed on Miami Sailing School’s websites (miamisailingschool.com)

Website/Websites:

Refers to miamisailingschool.com and related social media pages of Miami Sailing School, LLC.

Lead Person:

The individual completing the booking form, responsible for all members of their party. They have read and agreed to the Terms and Conditions and accept them on behalf of all members listed on the booking form.

Crew/Specified Party:

All persons named on the booking form for whom the Lead Person or the individuals themselves are responsible.

Agreement to Booking

  • A 25% deposit per person is required for sailing instruction, a 100% deposit for sailing charters, and a 10% deposit per person for passage sail instruction/adventure sailing with Miami Sailing School. This deposit confirms your acceptance of these booking conditions.
  • Acceptance of your booking will be confirmed via email, creating a contract as shown in the confirmation email.
  • All due payments, including any surcharges, must be paid either before departure or immediately after, at our discretion.

Cancellations & Rescheduling for Sailing Instruction

  • A 25% deposit is required for course registration and is non-refundable.
  • Rescheduling requests made more than 30 days before the lesson incur no fee. Within 30 days, a $150 reschedule fee applies.
  • Cancellations by the Company due to weather or unforeseen circumstances will result in rescheduling at no additional cost.

Cancellations & Rescheduling for Chartering

  • Cancellations more than 7 days before departure will receive a full deposit refund.
  • Cancellations 7-3 days before departure will receive a 50% deposit refund.
  • Cancellations within 2 days of departure forfeit the deposit.
  • Rescheduling requests are considered case-by-case at the Company’s discretion.
  • Cancellations by the Company due to weather or unforeseen circumstances will offer a 100% deposit refund if rescheduling is not possible.

Cancellations & Rescheduling for Passage Sail Instruction/Adventure Sailing

  • Payments made 90 and 60 days before departure are non-refundable, except under specific conditions explained below.
  • The initial 10% deposit is non-refundable. If you need to cancel after subsequent payments, we will attempt to re-book your spot and, if successful, issue a refund minus the 10% deposit.
  • We strongly recommend purchasing travel insurance.
  • If your application is not approved, all payments will be refunded.

Alcohol/Substance Abuse

You must be 21 or older to consume alcohol. Intoxication upon arrival or during the sail will result in cancellation of the sail, and you will be responsible for the full cost.

Gratuity

Gratuities for the captain and crew are customary and typically range from 15-20% based on service level.

Risks

  • Sailing involves inherent risks. By booking, you agree to release and hold harmless Miami Sailing School and its employees from liability for any injury, damage, or death. This extends to your invitees.
  • You must cover any medical expenses incurred for treatment of you or your invitees.
  • Disputes will be governed by Federal Maritime law, and if the Company’s position is upheld, you must reimburse attorney’s fees and costs.

Photography/Video Release

Authorized parties may carry out photography and/or video recording for promotional purposes. You agree to this use and acknowledge that copyright belongs to the authorized parties.

Third-Party Websites

The Company is not responsible for content, tours, or pricing displayed on third-party websites.
