Company: Florida Yacht Broker LLC, doing business as Miami Sailing School ™
1. Definitions
Company/We/Us: Florida Yacht Broker LLC, operating as Miami Sailing School ™.
Client/You/Your: The individual or entity booking a sailing course or charter.
Services: Sailing courses, charters, and related offerings.
Lead Person: Individual completing the booking, responsible for all participants.
Crew/Participants: All individuals named in the booking or attending the service.
2. Booking and Payment
- Full Payment Required: All bookings must be paid in full at the time of reservation.
- Preferred Payment Method: Zelle is preferred.
- Electronic Payment Fees: Other methods incur a 4% transaction fee.
- Accepted Methods: VISA, MasterCard, wire transfer, and Zelle.
- Not Accepted: American Express, personal checks, cashier’s checks, or money orders.
- Confirmation: Confirmed upon full payment and email receipt.
3. Cancellations and Rescheduling
By the Client: Payments are non-refundable. Rescheduling 30+ days in advance may be allowed. No-shows forfeit payment.
By the Company: We may reschedule or cancel for weather or other reasons. Affected clients may reschedule within 12 months or select another date.
4. Conduct and Safety
Alcohol Consumption: Alcohol is allowed for guests 21+. Intoxication is not permitted.
Inappropriate Behavior: Aggressive, abusive, belligerent, harassing, lewd, or similar conduct will result in immediate cancellation without refund.
Illegal Substances and Firearms: Prohibited. Violators may be removed and reported to authorities.
Captain’s Authority: The Captain’s decisions are final and must be followed at all times.
Smoking and Vaping: Not allowed below deck. If allowed, use leeward side away from others.
5. Client Responsibilities
- ASA Students: Expected to help with sailing, cooking, cleaning, and maintenance.
- Charter Guests: Must leave the yacht reasonably clean and organized.
- Vessel Condition: Clients are liable for damage caused by negligence or misuse.
- Health Certification: Clients confirm they are in good health for sailing activities.
- Insurance: Clients must carry their own health/travel insurance.
6. Certification and Course Completion
Certification is based on demonstrated competency. It is not guaranteed upon course completion.
7. Media Release
You consent to the use of photographs or videos taken during services for marketing or promotion.
8. Own Boat Instruction
- The vessel must meet USCG and ASA safety standards.
- Insurance must be maintained throughout instruction.
- Clients are responsible for instructor travel costs.
9. Liability and Indemnification
Sailing carries inherent risks. By booking, you release the Company and its affiliates from liability. You agree to indemnify us against claims arising from participation.
10. Governing Law
This agreement is governed by Florida law. Disputes will be handled in the appropriate Florida courts.
